Know all Men by these presents: That I Charles Hubbard Sen. of the County of Marion and State of oregon, do make and publish this my last Will and Testament; hereby revoking all former Wills by me made; that is to say, FIRST, after all my lawful debts are paid and discharged, the residue of my Estate real and personal, I give, bequeath and dispose of, as follows, to wit: First---I give and bequeath, at my decease to my son John McDade, and my daughter Ruth Sitton formerly McMillan the sum of one Dollar each to be paid out of My Estate for the reason, that I have heretofore Made advances to them severly, this is all that I desire that they shall have out of my estate. Second---I give and bequeath to my son George W. Hubbard the sum of One dollar to be paid out of my Estate and for the reason that I have this day deeded to him a certain tract of land, containing about one hundred and fifty acres, this one dollar is all that I desire that he should have out of my Estate after my death. Third---I give and bequeath to the heirs of my deceased daughter Keziah J. Kester One Equal share of my Estate with the other of my children hereinfafter provided for in the following mannor, to wit: to jessie W. the sum of one dollar to be paid out of my Estate after my decease, and for the reason that I have heretofore paid large sums of money for him, it is my desire that he should have only the one dollar, herein givena dn bequeathed to him. Fourth---I give and bequeath to Milton B. Kester the sum of one hundred dollars more than any one of the other heirs opf my said deceased daughter should receive out of my Estate as representatives of my said deceased daughter the sum to be taken out of the amount herein given and bequeathed to the heirs of my said deceased daughter Keziah J. Kester before any devision of it is made, and after the one dollar that is herein bequathed to Jesse W. Kester, and the one hundred dollars that is herein before given and bequeathed to Milton B. Kester. Then the residu or balance shall be devided equally between Charles S. Kester, Mithra J. Kester, Erva C. Kester, Edwin G. Kester, Margaret J. Kester, Sarah E. Kester, Mary M. Kester and Milton B. Kester. Fifth---I give and bequeath unto my sons and daughters herein after named all of my real and personal estate, that is not herein before given and bequeathed to my lawful heirs, in Equal proportions, to be paid to and devided amongst them Equally. That is to say to William C. Hubbard (one share) to Julianne Hatch formerly Jones (one share) Celia B. Young (one share) to Nancy R. Cooley (one share) to Charles O. Hubbard (one share) to Ephraim J. Hubbard (one share). All of the foregoing Bequests and interest to be paid and disposed of according to law. Sixth---I make, constitute and appoint my said son William C. Hubbard to be Executor of this my last will and testament, herby revoking all former wills by me made, and it is for this my desire that my said Executor shall serve as such Executor in settling up my estate without Bond or security. A serious difficulty was brought into the church, a young sister married a man that had a living wife in the neighborhood. the sister was cited to attend and answer to the charge of adultery. she appeared at the next meeting and answered for herself. The majority acquitted her of the charge. The minority being dissatisfied with the decision of the majority ask for a committee to be called from sister churches and their decision to be final which was granted. They called on Sulpher Lick, Troy and Little Bethel Churches. said churches sent three members each. The committee met on the 13th of Mar. 1830 and (here) David Brainbridge moderated, W. Wright, clerk, and preceeded to investigate the charge against the sister and unanimously recommended her inclusion. It appeared that the majority was unwilling to stand to the decision of the committee and retained the sister in fellowship. The minority being still dissatisfied withdrew from the church at the June meeting and subsequently they formed themselves into a church called Bryants Creek (at the present Ote school) about this time Elder Hubbard {NOTE...David Hubbard} resigned the pastorship of the church but I think still preached to the church.
